Family Law Case Studies

Case study 1

A father had concerns about his daughter's care as he was worried about the mother's depression and alcohol abuse.

After visiting his daughter and finding the mother drunk and incapable of looking after her he instructed Percy Hughes & Roberts to represent him in applying for an urgent Residence Order. This led to successfully placing his daughter safely with him and to arrange for safe contact with her mother. Longer term monitoring of the mother's drinking was arranged after she arranged treatment and after some months mother was well enough for a shared Residence Order with father.

Case study 2

The wife consulted Percy Hughes and Roberts in connection with the financial issues arising out of a Divorce. After mediation and negotiation failed to secure an agreement issuing a Financial Application for the District Judge to consider the financial outcome.

This led to the husband accepting the reality of the situation leading to an agreement being reached through solicitors. This provided for the wife and children to keep their home and have regular maintenance. The husband also moved out so that the wife and children could settle into their life without him.

The financial proceedings were then concluded with a Consent Order avoiding the need for Court attendances.

Case study 3

The father had previously used Percy Hughes & Roberts to help him obtain a Residence Order for his child who had special needs and whose mother couldn't properly care for them.

After a contact visit the mother failed to return the child and sought to change school which caused the father concerns about mother meeting his educational needs and the mother's understanding and ability to care properly.

The father consulted Percy Hughes & Roberts again to apply to the Court for his worries and concerns to be addressed and for enforcement of his Residence Order with the child to be returned to him.

A Social Worker was appointed and reports asked for from the child's school. The child was a teenager and old enough to be able to speak up clearly about how he felt and for weight to be given to that.

On the mother being prohibited from changing school the child's wishes were followed to stay with his mother and stay regularly overnight with his father.
