Types of Financial Arrangements

Financial arrangements relates to the financial rights each spouse has against the other in the event of a marriage ending.

Any settlement reached between the two parties can be made into binding and enforceable court orders, which include:

  • Clean Break Order - to finalise any potential claims available to either party
  • Maintenance Order - a party can be ordered to pay maintenance to the other party on an interim basis, a long term basis or for a set duration
  • Lump Sum Order - either spouse can be ordered to pay a capital sum of money by way of a single payment (although it may be possible for this to be paid by instalments)
  • Transfer of Properties Order � either spouse can be ordered to transfer all or any asset or property to the other spouse whether such asset or property is owned jointly or individually
  • Sale of Property and Division of Proceeds � this is generally used for houses. Additional Orders can be made to cover repayment of the mortgage, payment of professional fees and how the net sale proceeds should be divided
  • Power to vary trusts made between spouses � the court can vary nuptial agreements made in contemplation of marriage or after the marriage
  • Pension Orders - the court can order that pensions are shared by dividing them and can make Orders against a pension income stream, a lump sum or a death benefit
  • Legal Charge Provision - the sourt can give someone a charge for a share of monies or property and specifiy when a payment is triggered. Such as when children finish their education.

When the courts make financial orders, it will take into account aspects of the Matrimonial Causes Act 1973, such as the needs of the children, the duration of the marriage and the financial resources of each spouse.
