Financial Settlements on Divorce – Factors to Consider

The courts will normally take some or all of the following factors into account when deciding how best to appropriate the financial assets of a separating couple:

• The welfare of any children – When involved, children are always the court’s first consideration. Their housing requirements and day to day financial needs will be taken into account as a method of determining a fair division of assets.


• Financial needs – The re-housing needs of both the husband and wife will also be considered. Often, each will need to prepare a breakdown of their estimated outgoings on a monthly basis.


• The length of the marriage – In general, the longer the marriage, the larger the financial settlements upon divorce.


• Contributions – Often relevant when a husband or wife possessed significant assets prior to the marriage, or have amassed them during a period of separation.


• Bad behaviour or misconduct – Usually such factors are discounted in the determination of financial settlements on divorce, unless the behaviour is particularly extreme.


• Standard of living prior to marital breakdown – Often utilised as a method of splitting the overall available assets in a manner that is proportionate to the husband, wife or children’s standard of living during the marriage.
