LPAs first came into force in October 2007 as a result of the Mental Capacity Act 2005 as replacements for Enduring Powers of Attorney, allowing people (donors) who have mental capacity and are over the age of 18 to appoint another person (attorney) - or people - to make decisions on their behalf, if they become unable to do so themselves.
There are two kinds of LPAs:
Before an LPA can be used, you must have the document registered with the Office of the Public Guardian - without this, your attorney will have no legal authority to act on your behalf.
