Property Abandonment - Problems for the Landlord

One of the major legal issues that often arises is when a landlord wrongly presumes that a tenant has vacated a property and attempts to take possession of the property.

If the landlord acts improperly and without the necessary cautionary steps and the tenant has not in fact vacated the property then the Landlord may face an expensive compensation claim from the tenant for unlawful eviction.

The landlord must follow a set procedure if the landlord believes the property has been abandoned. As with all areas of Landlord and Tenant Law it is vital that landlords take care and make sure that they behave in a fashion which does not leave themselves open to future claims.
