FAQs 

How much notice do employees need when being made redundant?

The minimum notice period for employees being selected for redundancy will be the higher of either, the employees statutory notice, or, their contractual notice.  Statutory notice depends on their length of service. 

  • One month to two years - one weeks’ notice 
  • Two to 12 years - one week’s notice for each full year of employment 
  • 12 years or more - 12 weeks’ notice 

Is there a time limit for re-employing redundant staff? 

Where there has only been a short period between making someone redundant and rehiring them, this could be considered a continuation of their original employment. 

If this does occur, the employee may be required to return any statutory redundancy pay they received. In some cases, you may find yourself under investigation by HMRC if they believe that the redundancy was not genuine and were attempting to exploit the tax-free nature of redundancy payments. 

When should redundancy pay be paid?

Employees should be given statutory redundancy pay in the following circumstances: 

  • If they have been working for you under a contract of employment 
  • Have at least two years’ continuous service under a contract of employment 
  • Have been made redundant 

You should make the redundancy payment at the point where the employee is dismissed or soon after. Should you fail to pay redundancy pay when you are legally required to do so, your employee can make a claim to an employment tribunal within six months of the end of their employment.
